ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY.
1. Sponsor
The Shameless Snacks Monthly Apple Watch Giveaway (the "Giveaway") is sponsored by Shameless Foods, LLC d/b/a Shameless Snacks ("Sponsor"), located at 1019 Main St #1037, Bridgeport, CT 06604. Apple Inc. is not a participant in or sponsor of this promotion. The Giveaway is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., TikTok, Google LLC, AppLovin Corporation, or other paid social, mobile, or digital advertising platforms and networks. The Giveaway may be advertised through third-party advertising networks, mobile applications, and websites, including those operated by AppLovin Corporation; such parties do not sponsor, endorse, or administer the Giveaway and are not responsible for it.
2. Eligibility
The Giveaway is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age (or the age of majority in their state of residence, if greater) at the time of entry. Employees, officers, and directors of Sponsor and of any entity involved in the development, administration, or fulfillment of the Giveaway, and each of their respective parent companies, subsidiaries, affiliates, and advertising and promotion agencies, as well as the immediate family members (spouse, parent, child, sibling, and their respective spouses, regardless of where they reside) and household members (whether or not related) of any such person, are not eligible. The Giveaway is void where prohibited by law and is subject to all applicable federal, state, and local laws and regulations.
3. Giveaway Period
The Giveaway begins at 12:00:00 a.m. Eastern Time on the first day of each calendar month and ends at 11:59:59 p.m. Eastern Time on the last day of that same calendar month (each a "Giveaway Period"). Each Giveaway Period is a separate Giveaway. Entries do not carry over into subsequent months. The Giveaway will be conducted in a series of consecutive monthly Giveaway Periods, beginning with the Giveaway Period commencing on September 1, 2026. Sponsor reserves the right, in its sole discretion, to discontinue the Giveaway following the conclusion of any monthly Giveaway Period, beginning with the first (1st) monthly Giveaway Period, by updating these Official Rules; provided that the Giveaway will end automatically, with no further Giveaway Periods, following the conclusion of the twelfth (12th) consecutive monthly Giveaway Period. Sponsor's computer is the official timekeeping device for determining the timing of entries.
4. How to Enter
There are two (2) methods of entry. Regardless of method, each eligible entrant may receive only one (1) entry per Giveaway Period. If more than one entry is received from the same person, email address, or household during a single Giveaway Period, Sponsor may void all but the first eligible entry received for that Giveaway Period.
Method 1 – Automatic Entry via Qualifying Purchase (no additional action required): During the Giveaway Period, place your first-ever subscription order for any Shameless Snacks product at https://eatshameless.com, including subscription orders placed through Sponsor's checkout at https://cart.eatshameless.com (a "Qualifying Purchase"). A "Qualifying Purchase" means an entrant's first-ever subscription order for any Shameless Snacks product, and qualifies as an entry only if that first-ever subscription order is placed during the Giveaway Period. An entrant whose first-ever Shameless Snacks subscription order was placed before the start of the Giveaway Period is not eligible to enter via a Qualifying Purchase in that or any later Giveaway Period, whether or not the entrant maintains, cancels, or subsequently places a new subscription order, but may enter via Method 2. Eligible entrants who complete a Qualifying Purchase automatically will receive one (1) entry into the drawing for the Giveaway Period in which the order is placed. Cancelling a Qualifying Purchase after the Giveaway Period ends does not affect the entry.
Method 2 – Free Alternative Method of Entry ("AMOE"): During the applicable Giveaway Period, visit https://eatshameless.com/pages/monthly-giveaway-official-rules and complete the online entry form by providing your full name, valid email address, and state of residence, and confirming that you are at least eighteen (18) years of age and have read these Official Rules. AMOE entries are free, are limited to one (1) per person per Giveaway Period, and will be treated the same as purchase entries for purposes of winner selection. Submitting an AMOE entry does not require a purchase and is not conditioned on consent to receive promotional communications from Sponsor.
Entries generated by script, macro, bot, or other automated means are void. Entries that are incomplete, inaccurate, illegible, corrupted, late, or otherwise not in compliance with these Official Rules are void. Proof of submission is not proof of receipt by Sponsor. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed the entrant.
5. Drawings and Odds
One (1) winner will be chosen in a random drawing from all eligible entries received during the Giveaway Period. The drawing will be conducted within seven (7) days after the end of the Giveaway Period by employees or agents of Sponsor using a random number generator, and will be witnessed by at least two (2) Sponsor representatives and documented. Odds of winning depend on the total number of eligible entries received during the applicable Giveaway Period.
6. Winner Notification and Verification
Each potential winner will be notified by email at the email address provided at the time of entry within five (5) business days of the drawing. Each potential winner must respond within five (5) days after the notice is sent and may be required to confirm eligibility and provide any information reasonably requested by Sponsor to administer prize fulfillment, including a declaration of eligibility, a liability release, and, where lawful, a publicity release. If a potential winner cannot be contacted, fails to respond on time, fails to provide requested information, is found ineligible, or declines the prize, that potential winner may be disqualified and Sponsor may select an alternate winner by random drawing from the remaining eligible entries for the Giveaway Period. No more than two (2) alternate drawings will be held per Giveaway Period, after which the prize for that Giveaway Period may go unawarded. Prizes will be shipped to a United States address, and prize fulfillment is expected within approximately thirty (30) days after winner verification is complete.
7. Prizes
One (1) winner per Giveaway Period will receive one (1) Apple Watch Series 11, model, color, and band at Sponsor's discretion or, if that prize becomes unavailable, a comparable smartwatch of equal or greater value selected by Sponsor. Approximate Retail Value ("ARV") of each prize: $399.00. Limit one (1) prize per person, household, and email address per Giveaway Period. Prizes are non-transferable, non-exchangeable, and may not be redeemed for cash, except at Sponsor's sole discretion or where required by law. Winner is solely responsible for all federal, state, and local taxes and any other costs or expenses associated with acceptance and use of the prize that are not expressly stated in these Official Rules as included in the prize.
8. General Conditions
By entering, each entrant agrees to be bound by these Official Rules and by Sponsor's decisions, which are final and binding in all matters relating to the Giveaway. Sponsor reserves the right to disqualify any individual it reasonably believes has tampered with the entry process or the operation of the Giveaway, submitted fraudulent or noncompliant entries, or acted in violation of these Official Rules or in a disruptive or unsportsmanlike manner. Sponsor also reserves the right to cancel, suspend, or modify the Giveaway if fraud, technical failures, or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Giveaway, in which event Sponsor may, in its discretion, select winners from among all eligible, non-suspect entries received before the action taken by Sponsor. In the event of any conflict between these Official Rules and any advertising or promotional material, these Official Rules will control.
9. Release and Limitations of Liability
By participating in the Giveaway, each entrant agrees, to the fullest extent permitted by law, to release and hold harmless Sponsor and each of its parent companies, subsidiaries, affiliates, advertising and promotion agencies, the social media platforms on which the Giveaway may be promoted (including Meta Platforms, Inc., TikTok, and Google LLC), the advertising networks, mobile applications, and websites on which the Giveaway may be advertised (including AppLovin Corporation), and each of their respective officers, directors, employees, shareholders, representatives, and agents (collectively, the "Released Parties") from and against claims arising out of or relating to participation in the Giveaway or the acceptance, receipt, possession, or use or misuse of any prize, except to the extent caused by a Released Party's gross negligence, fraud, or willful misconduct or where such release is prohibited by law. The Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, delayed, garbled, damaged, or undelivered entries, emails, or communications; interrupted or unavailable network, server, Internet service provider, website, or other connections; computer, satellite, telephone, or cable transmission failures; or any technical, mechanical, typographical, human, or other error or problem connected with the Giveaway.
10. Privacy
Information collected from entrants will be used by Sponsor to administer the Giveaway and otherwise in accordance with Sponsor's privacy policy, available at https://eatshameless.com/policies/privacy-policy. Sponsor may send entrants who have separately opted in promotional communications regarding Sponsor's products and services; entrants may unsubscribe from such communications at any time by following the instructions in any such communication. Entry into the Giveaway, by either method, is not conditioned on consent to receive marketing communications. Sponsor will not share Giveaway entry information with unaffiliated third parties for their own marketing purposes except as disclosed in Sponsor's privacy policy or as required by law.
11. Disputes and Governing Law
Except where prohibited by law, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with the Giveaway, or any prize awarded, shall be resolved individually, without resort to any form of class action. Any such dispute shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, in accordance with the dispute resolution provisions of Sponsor's Terms of Service at https://eatshameless.com/policies/terms-of-service, which are incorporated by reference. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, and the rights and obligations of entrants and Sponsor in connection with the Giveaway, shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice-of-law or conflict-of-law rules that would cause the application of the laws of any other jurisdiction. Entrants waive any right to claim punitive, incidental, or consequential damages or attorneys' fees, and any damages are limited to actual out-of-pocket costs of entering, if any.
12. Severability
If any provision of these Official Rules is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law and the remaining provisions shall remain in full force and effect.
13. Winner List
For the names of the winners, send an email with the subject line "Giveaway Winner List" to support@eatshameless.com, or send a self-addressed, stamped envelope to: Shameless Snacks Monthly Giveaway Winner List, c/o Shameless Foods, LLC, 1019 Main St #1037, Bridgeport, CT 06604, to be received no later than ninety (90) days after the last day of the Giveaway Period for which the winner list is requested. Vermont residents may omit return postage. Winner first names and states of residence will also be posted at https://eatshameless.com/pages/giveaway-winners after each Giveaway Period.
